Pathfinder Terms & Conditions

By participating, ‘You’ or ‘Your’ being, our Microsoft contact as per the Registration Details and ‘Us’ and ‘We’ being Advania UK Limited (each a ‘Party’ and together the ‘Parties’) understands and agrees to be fully and unconditionally bound by the these terms and conditions which consist of the Registration Details (detailed below) and any other information on the Pathfinder  website page issued by Advania UK Limited into which these Terms and Conditions are incorporated by reference (the “Terms and Conditions’’).

Any colleagues, friends and other referrals which You invite to participate in the Pathfinder game shall be subject to these Terms and Conditions also (hereinafter “Referral(s)”.

Registration Details: The Pathfinder game will only be playable by people who register with a Microsoft.com email address. We just need your name and email address to register and participate. Once registered you shall be entitled to participate in the Pathfinder game and invite Referral(s) you wish to participate in the competition.  

You and Your Referrals Personal Data: By participating in the Pathfinder game, each Party agrees to comply with applicable data protection. Advania UK Limited will store data that they give Us voluntary about You during the registration process or thereafter in order to register to play the game in accordance with the Advania UK Privacy Policy which can be found here https://advania.co.uk/privacy-policy/  ( i.e. a Microsoft.com email address for the purposes of making a charitable donation and to contact you regarding services which we believe you may be interested in). Furthermore, the fact that the refer a Referral functionality does not retain any data (i.e. we do not store email addresses that are inputted, it simply prompts You as the user to send an email with link to your Referral(s)).

Charity Donation: By You and/or your Referral(s) participating and playing the Pathfinder game, We agree to make a one off donation capped at a maximum of GBP £5,000.00 to Great Ormond Street Hospital Children’s Charity (registered charity number ‍1160024 (https://www.gosh.org/donate/) during the period 14 November 2023 to 31 December 2023. The full and final donation will be made by 28 January 2024. Participation and playing of the game by You or Your Colleagues/Referral outside this time period will not result in Advania UK Limited making any further donations. You and Your Referrals may play the Pathfinder game as many times as you wish and refer Referral(s) to play the game.

By accepting Advania UK Limited providing donation(s) to the charity as outlined herein, You and Your Referral(s) agrees to forever release and hold harmless Advania UK Limited and Great Ormond Street Hospital Children’s Charity from and against any and all claims, demands, losses, liabilities, damages, costs, or causes of action arising out of or related to participation in the Pathfinder game and the charity donation.

Advania UK Limited may disqualify you and any of your Referral(s) if You and Your Referral(s) participation does not meet any one or more of the requirements set out in these Terms and Conditions, if You and Your Referral(s) participation includes any objectionable material or infringes the rights (including intellectual property rights and data protection rights) of any third party, or if You and Your Referral(s) tamper in any way with the operation of the Pathfinder game.

A failure by either Party (and/or is Referral(s) to exercise or enforce any rights conferred upon it by these Terms and Conditions shall not be deemed to be a waiver of any such rights or operate so as to bar the exercise or enforcement thereof at any subsequent time or times. 

A person or entity (other than the Referral(s) who is not a party to these Terms and Conditions shall have no right to enforce or to enjoy the benefit of any term of these Terms and Conditions. 

If at any time any provision of these Terms and Conditions shall be or shall become illegal, invalid or unenforceable in any respect, the legality, validity and enforceability of the remaining provisions of these Terms and Conditions shall not be affected or impaired thereby, and shall continue in force as if such illegal, invalid or unenforceable provision was severed from these Terms and Conditions. 

Advania UK Limited may remove and cease the promotion of this Pathfinder game and /or block You and Your Referrals participation in the Pathfinder game at any time at our sole discretion. 

These Terms and Conditions are governed by the Laws of England and Wales.
